GENERAL CONDITIONS

The terms of sale apply to the purchase of products between the buyer (hereinafter Buyer) and SILVERITA OÜ registry code 14490218 (hereinafter SILVERITA e-shop) in the silverita.ee e-shop.

In matters not regulated in the terms and conditions below, the Buyer and the SILVERITA e-shop shall be guided by the legislation in force in the Republic of Estonia and other acts regulating the relations between the parties.

SILVERITA e-shop reserves the right to make changes to the terms and conditions and sales prices in order to develop its e-shop. The changes will take effect from the moment they are published on the silverita.ee website. If the changes came into force after the submission of the Buyer's order, the legal relationship between the Silverita e-store and the Buyer shall be subject to the terms and conditions in force at the time of the Buyer's delivery, unless otherwise provided by law or this Agreement.

ENTRY INTO FORCE OF THE SALE AGREEMENT

The SILVERITA e-shop sells and the Buyer buys the products offered in the e-shop.

The sales contract between the SILVERITA e-store and the Buyer enters into force upon receipt of the amount payable according to the order confirmation to the current account of SILVERITA OÜ.

By placing an order and making a payment in the SILVERITA e-shop, the Buyer confirms that he has read the terms of sale and agrees with them.

PRICES

All prices of the SILVERITA e-store are presented in Euros and include 20% VAT valid in the Republic of Estonia.

For purchases with a total amount of less than 50 euros, a fee will be added to the price for the delivery of the goods according to the delivery method chosen by the Buyer. The delivery fee will be shown to the buyer when ordering.

The prices of the products sold are indicated next to the products and do not include transport costs. In the case of discounted campaign prices, the products show both the new price and the crossed-out old price.

SILVERITA e-shop reserves the right to adjust prices, the changes will take effect from the moment they are published on the SILVERITA e-shop website. If the Buyer submitted his order before the price changes took effect, the price that was reflected on the invoice at the time of placing the order applies to him. The buyer has no right to demand compensation for the price difference.

SILVERITA e-shop reserves the right to cancel the sale if a human error or technical error has been made when entering the product into the e-shop. For example, an error in entering the price or a technical error in the system if the price of the product is reflected in the SILVERITA e-shop with a large difference from reality (for example, if a product paying 50 euros is accidentally sold for 5 euros). Consequently, we assume that the Buyer understands that this is an error and that the product is not for sale at such a price.

PAYMENT FOR PRODUCTS

Payment is made via Paysera, outside the SILVERITA e-store environment. The SILVERITA e-store does not have access to the Buyer's bank account data at any time.

Payment for SILVERITA e-store products is made via different bank links (Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele etc.).

Payments will be accepted in Euros.

The sales contract is considered concluded and the execution of the order will start immediately after the Buyer has paid 100% of the order confirmation.

PRODUCT INFORMATION AND AVAILABILITY

Information about the goods is provided in the SILVERITA e-shop directly at the product. If you do not understand the product information, you have the right to ask for more information in the SILVERITA e-shop (info@silverita.ee or call +372 53993477).

Product information and product images come directly from the manufacturers and the SILVERITA e-shop is not responsible for their accuracy. The pictures of the products are illustrative.

The availability of goods and product information may change in the SILVERITA e-shop. The changes will take effect from the moment they are published in the SILVERITA e-store.

SILVERITA is a distributor of various brand jewelry. Therefore, the SILVERITA e-shop reserves the right to withdraw from the order if the goods are sold at the same time. In this case, the Buyer will be notified immediately by e-mail or telephone and the money paid will be returned to the Buyer's account within 1-3 working days.

Existing Products will not be booked until the sales contract enters into force.

If you notice a product in the SILVERITA e-shop that could be of a different color or size, you can always contact us and we can find out if the product can be ordered / manufactured according to your wishes (info@silverita.ee or call +372 53993477).

HOW TO BUY IN OUR E-SHOP?

By placing an order and making a payment in the SILVERITA e-shop, the Buyer confirms that he has read the purchase rules and agrees with them.

Before making a purchase, check out the SILVERITA e-store:

When you find a suitable product, select: quantity, color, size / length and place the product in the shopping cart using the "Add to cart" button. Adding a product to the cart does not oblige you to buy this product.

You can browse the products in the SILVERITA e-shop or go to your shopping cart, where you can review the selected products and, if necessary, change or delete them (by clicking on the cross).

On the payment page, please fill in all required fields. The amount of the fee that can be paid via the bank link is then displayed on the screen.

The buyer undertakes to provide true information when placing the order.

An invoice will be sent to your e-mail address to confirm the purchase. The SILVERITA e-shop does not add an invoice when printed.

DELIVERY

After paying the invoice by the Buyer, the SILVERITA e-shop will complete the order and hand it over to our logistics partners for delivery. The SILVERITA e-shop will post the order within a maximum of 1-3 working days after payment for the order. Generally, the ordered product will reach the Buyer in Estonia within 2-4 working days. The maximum delivery time is 7 working days.

The delivery terms indicated in the SILVERITA e-store are valid from the moment of payment of the invoice and receipt of the order amount to the current account of the SILVERITA e-store.

The Buyer is obliged to notify the SILVERITA e-store immediately before the delivery of the goods about the change of the destination or the agreed time.

Avoidance of delays and misunderstandings in the delivery of goods depends on the accuracy and correctness of the information provided in the order. SILVERITA e-shop is not responsible for delays in the delivery of products and misunderstandings if the delay or misunderstanding is due to the inaccuracy of the information provided by the Customer when placing the order.

SILVERITA e-shop is not responsible for the delay in delivery of the product if the product has been handed over to the logistics partners on time, but the delay in delivery is due to circumstances that could not be influenced or foreseen by SILVERITA e-shop.

The obligation to deliver the SILVERITA e-store is considered fulfilled when the product has reached the Omniva or Smartpost parcel machine.

METHODS OF DELIVERY

Omniva parcel machine in Estonia (€ 2.95). FREE shipping on purchases from 50 €. Delivery 1-5 working days. You can receive the parcel from the machine every hour, every day 24/7.

Itella SmartPOST parcel machine in Estonia (€ 2.59). FREE shipping on purchases from 50 €. Delivery 1-5 working days. SmartPOST parcel machines are located in various shopping centers all over Estonia and are open as long as the shopping center is open. When the parcel arrives, an SMS with a door code will be sent to your mobile phone. All you have to do to receive the package at the machine is enter the door code contained in the SMS on the touch screen - after that, the right locker will open and the package is here!

RETURN AND EXCHANGE

Products purchased from the SILVERITA e-store can be returned within 14 days of receiving the product.

We will refund you for the returned products within 3-7 working days from the delivery of the products to the SILVERITA e-store.

The cost of returning the product is covered by the Buyer.

In order to return the Product, the Buyer must submit a request to withdraw from the purchase of the Product by e-mail. A application must be made to the e-mail address info@silverita.ee. We will respond to the sent application within 5 working days.

IT IS NOT POSSIBLE TO EXCHANGE PRODUCTS IN THE SILVERITA e-shop, as we cannot guarantee that the same product or another product is currently in stock. The product can only be returned and a new purchase must be made if desired.

CONDITION OF THE PRODUCT TO BE RETURNED:

The product to be returned must be accompanied by the original labels affixed directly by the manufacturer (this is a product certificate attesting to the quality of the product). The label must not be damaged (cut, dirty, damaged or wrinkled).

The product to be returned must not bear any signs of use. The product must not be worn or damaged.

If it turns out that the product has been used / deteriorated or the label has been cut / damaged, the SILVERITA e-store has the right to set off the decrease in the value of the product due to the amount paid by you for the product and refundable to you. The SILVERITA e-shop will send you an application for set-off.

RESPONSIBILITY

SILVERITA e-shop is not responsible for mistakes made by the postal service provider. For example, for possible delays in delivery, loss of or damage to the product.

SILVERITA e-shop is not responsible for possible damages that occurred because the Buyer has not read these TERMS.

SILVERITA e-shop is not responsible for the impossibility of fulfillment due to incorrect data provided by the Buyer or any consequences thereof.

SILVERITA e-shop is responsible for the Buyer to the extent of the sale price of the product. SILVERITA e-shop does not take responsibility for damages caused by defective Products, such as damage to property or information, loss of turnover or profit.

PROCEDURE FOR SUBMITTING CLAIMS

Products sold in the SILVERITA e-store have a 2-year claim deadline. During the first six months, the costs of verification will be borne by the SILVERITA e-shop, regardless of who is to blame for the occurrence of the defect or how the verification of the cause of the defect is performed (for example, with the help of an independent expert examination). For the remaining year and a half, the offender is obliged to bear the costs, ie the SILVERITA e-shop in case of a manufacturing defect or a defect caused by the trader's performance, and the Buyer in case of defects due to incorrect use of the product.

If it turns out that the Product has defects for which the SILVERITA e-shop is responsible, we will repair or replace the defective product. If the Product cannot be repaired or replaced, we will refund the Buyer.

SILVERITA e-shop is not responsible for damages caused by improper use of the purchased Products (defects in the product due to the Buyer's fault), as well as for delivery delays, if this is due to circumstances beyond SILVERITA e-shop.

The SILVERITA e-shop is obliged to respond to the Buyer's claim within 14 days of receiving it.

Matters not resolved separately in the terms and conditions of this Agreement shall be governed by the legislation in force in the Republic of Estonia.

If the Buyer and the SILVERITA e-shop are unable to resolve the dispute by agreement, then both the Buyer and the SILVERITA e-shop have the opportunity to turn to the Consumer Disputes Committee to protect their interests.

The Commission is competent to settle disputes arising from a contract concluded between the Buyer and the Contractor, which the parties have not been able to settle by agreement and if the value of the disputed goods or services is 20 euros or more. The review of the complaint by the committee is free of charge for the parties.

SILVERITA e-shop wants and hopes to resolve disputes through negotiations.

CONFIDENTIALITY AND PRIVACY

The chief processor of personal data of the SILVERITA e-store is SILVERITA OÜ (registry code 14490218), phone +37253993477, e-mail info@silverita.ee).

All personal data of the Buyer that has become known during the visit to the SILVERITA e-store and the performance of purchases will be treated as confidential information.

Payments in the SILVERITA e-store are made through the authorized processor Paysera, outside the SILVERITA e-store environment. The SILVERITA e-store does not have access to the Buyer's bank account data at any time.

 

What personal data is processed in the SILVERITA E-store:

  • Name, telephone number and e-mail address or delivery address of the goods (used to manage the customer's orders, to deliver the goods or in other cases prescribed by law);

  • Buyer's bank account number (used to return payments to Buyer);

  • Purchase date, goods, quantity, customer data (used to compile an overview of purchased goods and services and to analyze customer preferences);

  • Customer support information such as e-mail, telephone number, name (used to resolve issues related to the provision of goods and services);

  • The IP address or other network identifiers of the e-shop user (used to provide the e-shop as an information society service and to compile web usage statistics).

 

When registering as a customer, the SILVERITA e-shop collects the following information:

  • Name;

  • E-mail;

  • Demographics such as zip code;

  • Phone number;

  • Other customer related information.

This information will help us understand more customer needs and provide better service, but we will:

  • Does not disclose information to third parties;

  • Ability to use data to develop products / services;

  • We may send e-mails: about new products, good offers or anything else that may be useful information for the customer (we will send the Buyer newsletters and offers to the Buyer's e-mail address only if the Buyer has requested by entering the e-mail address on the website and provided The Buyer has the opportunity to unsubscribe from e-mail offers and newsletters at any time by notifying us by e-mail);

  • Ability to use data for market analysis purposes;

  • We may use an email or telephone number to contact the customer.

 

Use of cookies in the SILVERITA e-store:

A cookie is a small text file that is stored in the browser of a user's computer or mobile device when a website is visited.

SILVERITA e-shop uses cookies to:

  • remember user preferences

  • receive information to customize our websites.

The visitor has the right to refuse to save cookies on the computer. If desired, the visitor must change their browser settings. When blocking cookies, the visitor must take into account that all the functions of the website may no longer be available to the visitor after blocking cookies.

 

NON-PURPOSE USE OF SILVER-FREE E-SHOP CONTENT

  1. Non-intended use of the SILVERITA e-store, such as copying, modifying and publishing the content for any purpose without the written permission of SILVERITA OÜ, is prohibited.

  2. Any activity that may interfere with the operation of the SILVERITA e-store is prohibited and will be considered as an illegal attack.
